MEMBERSHIP TERMS & CONDITIONS 
 

IMPORTANT DISCLAIMER 

This document is provided for informational purposes only and does not constitute legal advice. Fitclub Collective recommends seeking independent legal counsel regarding the interpretation or application of these Terms & Conditions. 

By purchasing a membership, class pack, trial, or attending any Fitclub Collective activity, you acknowledge that you have read, understood, and agreed to the following Terms & Conditions. 

1. DEFINITIONS 

Agreement: These Terms & Conditions, including all membership details and policies established by Fitclub Collective. 

Classes: Any training session, event, or fitness activity conducted by Fitclub Collective trainers. FCC: Fitclub Collective S.L. 

FCC Training: The proprietary training methodology created by Founder Camila Monguzzi.

Fees: All payments associated with memberships, packs, classes, penalties, or services.

Guest: Any non-member attending a class or activity through a guest pass or invitation.

Member: Any person holding an active membership, class pack, or subscription with FCC.

Membership: Any recurring subscription, multi-class pack, or training plan offered by FCC. 

Online Booking Platform: FCC’s website or app used to purchase, reserve, and manage memberships and classes. 

Trainer: Any coach, instructor, staff member, or representative leading or assisting in classes.

You / Your: The Member or Guest accepting these Terms & Conditions.

2. MEMBERSHIPS, FEES & PAYMENTS 

All prices, fees, and membership conditions are available on the FCC website and mobile application.

FCC offers different types of memberships, with their specific features, benefits, and conditions outlined at the time of purchase.

Memberships operate on a recurring payment basis and renew automatically in accordance with the terms applicable to each membership type.

Failure to process payment may result in:

  • Immediate suspension of the membership

  • Inability to book or attend classes

  • Outstanding balances remaining due

If payment remains outstanding for more than seven (7) days, FCC reserves the right to cancel the membership and pursue any outstanding amounts.

Enrollment Fee (Madrid Only) 

All memberships in Madrid are subject to a one-time enrollment fee of €50.

 

Guest Passes 

All active memberships include: 

  • 1 guest pass per month 

  • Access to in-house FCC studio events 

External or large-scale events may require separate payment or registration.

 

Late Cancellation & No-Show Policy 

To ensure fairness to all members, the following fees apply: 

  • Madrid: €12 

  • Segovia: €8 

These fees apply when: 

  • A class is cancelled less than 180 minutes before start time 

  • A member does not attend a reserved class

By providing a payment method, you authorize FCC to charge applicable late cancellation or no-show fees automatically. 

3. MEMBERSHIP COMMITMENT & AUTO-RENEWAL 

The specific conditions of each membership, including its minimum duration and payment terms, will be communicated at the time of purchase.

Mid Day, Full Access, and Multi-Studio memberships are subject to a minimum commitment of two (2) months. Once this period has ended, the membership will continue to renew automatically on a monthly basis unless cancelled in accordance with this policy.

Flex memberships are not subject to any minimum commitment and renew automatically on a monthly basis until cancelled.

To cancel a membership, members must send an email to team@fitclubcollective.com or request cancellation directly at reception.

Cancellation requests must be submitted at least thirty (30) days prior to the next renewal date. Requests received within this timeframe will prevent the charge for the following billing period.

Memberships subject to a minimum commitment cannot be cancelled before the end of the initial period, except in the case of a valid medical reason supported by documentation.

No refunds will be issued under any circumstances for payments already processed.

4. EARLY TERMINATION & MEDICAL EXCEPTIONS 

Membership termination before the end of the agreed commitment period will only be considered in cases of: 

  • Serious illness 

  • Permanent physical incapacity 

  • Medical inability to continue exercise activity 

Valid official medical documentation must be submitted within three (3) days from the issuance date. 

Failure to notify FCC within this timeframe may result in the request being denied.

FCC reserves the right to request additional documentation when necessary. 

5. FREEZING MEMBERSHIPS 

The freezing conditions vary depending on the type of membership.

Memberships with a minimum commitment of two (2) months include up to fifteen (15) days of freezing per every two (2) month period. Requests can be made via email, WhatsApp, or directly at reception.

Flex memberships do not include automatic freezing; however, FCC may consider individual freezing requests under exceptional circumstances.

All freeze requests are subject to approval by FCC and must be confirmed in writing.

FCC reserves the right to approve or reject any freeze request.

6. HEALTH & SAFETY 

By participating in FCC activities, you confirm that: 

  • You are physically fit to participate in exercise activities 

  • You do not suffer from any medical condition that could be aggravated by exercise

  • You will seek medical advice if uncertain about your ability to participate safely 

You agree not to attend classes while suffering from: 

  • Contagious illnesses 

  • Infections 

  • Any condition that may place yourself or others at risk 

Participation in FCC classes involves intense physical activity and carries inherent risks, including injury, illness, or death.

You voluntarily assume all risks associated with participation. 

FCC is not responsible for injuries, damages, losses, or health complications arising from participation, misuse of equipment, or failure to follow trainer instructions. 

7. LIABILITY WAIVER

By attending any FCC class, event, or activity, you acknowledge and accept full responsibility for your participation. 

Fitclub Collective, its owners, employees, trainers, and affiliates shall not be held liable for: 

  • Personal injury 

  • Property damage 

  • Loss or theft 

  • Accidents 

  • Death 

Except where liability cannot legally be excluded under applicable law. 

8. MINORS 

Participants under the age of 18 must provide written consent signed by a parent or legal guardian prior to participation. 

The parent or guardian accepts full responsibility for the minor’s participation and compliance with these Terms. 

9. LATE ARRIVAL POLICY 

A maximum grace period of five (5) minutes is permitted after class start time. For safety and class quality reasons, entry will not be allowed after this period. Late arrivals will be treated as no-shows and corresponding fees will apply. 

10. PRIVACY & MEDIA CONSENT 

By registering with FCC, you consent to the collection and use of personal information related to: 

  • Membership management

  • Health and fitness information 

  • Class participation 

  • Communication and marketing purposes 

FCC may photograph or record classes, events, or facilities for promotional and marketing purposes. 

By attending FCC activities, you authorize the use of your image, voice, or likeness in FCC promotional materials unless otherwise requested in writing. 

11. MEMBER RESPONSIBILITIES 

Members agree to: 

  • Follow all trainer and staff instructions 

  • Respect FCC facilities, equipment, staff, and community 

  • Use equipment safely and responsibly 

FCC reserves the right to suspend or terminate memberships due to: 

  • Unsafe behavior 

  • Harassment 

  • Disruptive conduct 

  • Violation of these Terms 

Members are financially responsible for damages caused through negligence or misconduct. 

12. COMMERCIAL ACTIVITY 

Unauthorized commercial activity within FCC facilities is strictly prohibited. This includes: 

  • Personal training services 

  • Selling products or services 

  • Soliciting clients or members 

Written authorization from FCC management is required for any commercial activity.

13. GUEST POLICY 

Guests must comply with all FCC rules, policies, and Terms & Conditions. Members are responsible for ensuring their guests understand and respect FCC policies. Each active membership includes one (1) guest pass per month. 

14. PERSONAL BELONGINGS

FCC is not responsible for lost, stolen, or damaged personal belongings within the facilities. Members are strongly encouraged to use lockers for valuables at all times. 

15. SCHEDULES, CLASSES & OPERATIONS 

FCC reserves the right to: 

  • Modify schedules 

  • Change trainers 

  • Adjust class formats 

  • Cancel classes or events 

Operational, safety, or unforeseen circumstances may require such changes. These modifications do not entitle members to refunds or compensation. FCC will make reasonable efforts to communicate relevant updates in advance.

16. FORCE MAJEURE

FCC shall not be held liable for delays, interruptions, or inability to perform obligations due to events beyond its reasonable control, including but not limited to: 

  • Natural disasters 

  • Government restrictions 

  • Pandemics 

  • Technical failures 

  • Strikes 

  • Emergencies 

If such circumstances continue for more than one month, either party may terminate the Agreement without penalty. 

17. SEVERABILITY

If any provision within these Terms & Conditions is deemed unlawful or unenforceable, the remaining provisions shall remain valid and enforceable. 

18. FINAL ACCEPTANCE 

By purchasing, booking, attending, or participating in any FCC service, class, membership, or activity, you confirm that: 

  • You have read and understood these Terms & Conditions 

  • You voluntarily accept all policies outlined herein 

  • You agree to comply with all FCC rules and procedures
