MEMBERSHIP TERMS AND CONDITIONS DISCLAIMER

FCC TRAINING MEMBERSHIP AND TRIALS: TERMS AND CONDITIONS

 1.⁠ ⁠DEFINITIONS

Agreement: This document, including the details and terms and conditions of Fitclub Collective.

Class/Classes: Exercise sessions conducted by a trainer from Fitclub Collective at a studio.

Fees: The payment required for a Membership or individual class.

FCC: Abbreviation for Fitclub Collective S.L.

FCC Training: The method created by Founder Camila Monguzzi.

Guest: A person attending a class who is not an active Member.

Health Form: The screening form required before participation in any class.

Member: A person holding a Membership with Fitclub Collective.

Membership: Any month-to-month, multipass, or plan membership with FCC.

Online Booking: The system for viewing, selecting, and purchasing classes or memberships.

Terms: The terms and conditions outlined in this document.

Trainer: Any person instructing or assisting in a class.

You: The Member or Guest agreeing to the terms outlined in this Agreement.
 

 2.⁠ ⁠FEES

Fees and the terms of this Agreement can be found on our webpage or requested as a physical copy.

If payment is not made when due, Membership may be suspended, and access to classes denied until all outstanding amounts are paid.

Membership may be terminated if any fees remain unpaid for seven days, and Members will still be liable for outstanding amounts.

Late cancellation & No-show fees:

Madrid: €12 (applies if class is not cancelled at least 180 minutes prior, or if the Member does not attend).

Segovia: €8 (applies under the same conditions as above).

Enrollment Fee (Madrid only): All memberships in Madrid require a one-time enrollment fee of €50.

Guests: All memberships (Madrid and Segovia) include 1 guest pass per month.

Minimum Commitment: All memberships (Madrid and Segovia) require a minimum commitment of 4 months.

Events:

All memberships (Madrid and Segovia) include access to all internal studio events.

Note: “Big events” may be excluded and may require separate payment or registration.

Membership contracts cannot be broken before the end of their term, unless valid medical justification exists. In such cases, you are exonerated of all permanency fees.

Payments via direct debit must be made through the FCC website/app. By agreeing to these terms and providing a payment method, you authorize FCC to deduct fees from your account.
 

 3.⁠ ⁠HEALTH & SAFETY

By becoming a Member or signing up for a class, you confirm:

You are in good health and have no medical conditions preventing you from exercising.

You do not have a condition that may be aggravated by exercise.

If uncertain, you must seek professional medical advice before participating in any class.

You will not participate in a class if you have an infection, contagious illness, or other risk to yourself or others.

WARNING: Participating in FCC classes involves strenuous physical activity that may not be suitable for everyone. Improper equipment use or failure to follow a trainer's instructions may lead to injury or death.

You agree to provide accurate health and fitness information before and during your time with FCC. Misleading information that results in injury or death is your responsibility, and FCC denies any liability.

By signing this Agreement, you assume all risks associated with participating in FCC activities. FCC is not responsible for any injury, loss, or damage, including personal injuries or death.
 

 4.⁠ ⁠LIABILITY WAIVER AND PARENTAL CONSENT

Liability Waiver: By participating in Fitclub Collective classes, you agree to a liability waiver releasing Fitclub Collective from any and all liability for injuries sustained during your participation in our classes.

Minors: For members under the age of 18, a parent or legal guardian must sign a parental consent form acknowledging the terms and conditions and assuming liability for the minor's participation.

FCC is not liable for death or injury caused by negligence, unless expressly stated in this Agreement.
 

 5.⁠ ⁠LATE ARRIVAL POLICY

A 5-minute grace period is allowed for late arrivals. Members/Guests arriving after the grace period will not be permitted entry to the class and will be charged the no-show fee (according to the studio’s applicable rate: €12 Madrid / €8 Segovia).
 

 6.⁠ ⁠EARLY TERMINATION

Memberships cannot be cancelled before the end of their term unless valid medical justification is provided. No refunds will be issued under any circumstances.

In the case of medical justification, the Member must inform FCC within a maximum of three (3) days from the date the medical justification is issued. Medical documentation must be valid, official, and clearly indicate the inability to continue physical activity.

Failure to notify FCC within this timeframe will result in the termination request being denied, and the membership will continue under its original terms.
 

 7.⁠ ⁠AUTO-RENEWAL PERMANENCE

In the case of an auto-renewed membership, the original permanence period (minimum commitment length of 4 months) still applies and must be fulfilled.

Members must provide FCC with a written notification of their intent not to renew their contract at least 20 days prior to the contract's expiration date.
 

8.⁠ ⁠PRIVACY

When applying for a Membership or Class, you consent to FCC accessing your personal information for health, fitness, and nutrition purposes.

Photos, videos, or recordings of Members or Guests may be taken for promotional purposes. By participating in a class, you agree to the publication of such media.
 

9.⁠ ⁠YOUR RESPONSIBILITIES

You must follow any instructions from trainers or staff regarding health, safety, and proper use of equipment. Failure to do so may result in suspension or cancellation of Membership.

You agree to pay for any damages to FCC facilities, equipment, or property caused by negligence, willful misconduct, or violation of this Agreement.
 

10.⁠ ⁠COMMERCIAL ACTIVITY

Business activity, such as offering personal training services or selling goods at FCC, is prohibited unless given written permission by FCC. FCC reserves the right to revoke this permission at any time.
 

11.⁠ ⁠FREEZING YOUR MEMBERSHIP

Membership freezing is not permitted unless supported by valid medical justification or explicitly authorized by FCC.

Any freeze approved by FCC for non-medical reasons must be confirmed in writing via email. Verbal approvals or informal communications will not be considered valid.

FCC reserves the right to approve or deny freezing requests at its sole discretion.
 

12.⁠ ⁠CANCELLING YOUR MEMBERSHIP

You may cancel your membership due to serious illness or permanent physical incapacity during the membership term, supported by medical documentation. No administration fee will apply.
 

13.⁠ ⁠TERMINATION

FCC may terminate your membership if you breach this Agreement. You will be liable for fees up to the date of termination and any costs incurred due to the breach.
 

15.⁠ ⁠GUESTS

Guests must comply with all relevant clauses outlined in this document, including health and safety, privacy, and behavior rules.

All memberships (Madrid and Segovia) allow 1 guest pass per month.
 

16.⁠ ⁠RESPONSIBILITY FOR PERSONAL BELONGINGS

The center assumes no responsibility for clients’ personal items that are forgotten, lost, damaged, or stolen within the facilities.

The use of lockers is mandatory for storing valuable belongings.
 

17.⁠ ⁠OTHER LEGAL MATTERS

FCC is not responsible for events beyond our control, such as force majeure. Should such events continue for more than a month, either party may cancel the Agreement without penalty.

FCC reserves the right to modify class schedules, instructors, class formats, or cancel classes when necessary due to operational, safety, or unforeseen circumstances. Such changes do not entitle Members to refunds or compensation.

FCC will make reasonable efforts to notify Members of any changes in advance through the usual communication channels.

If any part of this Agreement is deemed unlawful or unenforceable, the remaining terms will remain valid.
