MEMBERSHIP TERMS AND CONDITIONS DISCLAIMER

This document does not constitute as legal advice and must not be relied upon by you as a substitute for legal advice. We are not responsible for any action taken or not taken in reliance on this document.

FCC TRAINING MEMBERSHIP AND TRIALS: TERMS AND CONDITIONS

DEFINITIONS:

Agreement means this agreement, comprising of the details and the terms and conditions of Fitclub Collective.

Class or Classes means an exercise class conducted by a trainer from Fitclub Collective at a studio.

Fees means the fees payable for a Membership or once off payment for an individual class.

FCC is the abbreviation of Fitclub Collective S.L.

FCC Training means the method that has been created by Founder Camila Monguzzi

Guest means any person who attends a class or classes who is not an active Member.

Health form is the questionnaire and form that FCC requires as screening before participating in a Class.

Member means a person who holds a Membership with Fitclub Collective.

Membership includes a month to month membership, multipass membership or a plan membership.

Online booking means the online system in which Members or Guests can view and select a Class to attend and purchase a Membership.

Terms means these terms and conditions.

Trainer means any person who is instructing, or assisting with the instruction of a class.

̈You ̈ means the Member or Guest subject to this Agreement.

2. FEES

The Fees you have to pay and the terms of this Agreement are accessible on our webpage and can be provided to you in a physical copy.

If you do not make a payment when it is due, your Membership may be suspended and you could be refused access to a Class until all outstanding amounts have been paid.

Your membership may be terminated if any Fees remain unpaid for 7 days period of time.

You will still be liable to pay all pending amounts.

If the client has a valid justification to break the permanence of the contract with Fitclub Collective, the client will have to pay 50% of the remaining amount of the totality of the contract.

If you pay any Fees, by direct debit, then this will through our website.

By agreeing to these terms and conditions and providing your desired payment method, you are authorizing us to deduct Fees from your account.

3. HEALTH & SAFETY

When you become a Member/sign up for a class and each time you participate in a Class you must ensure that

You are in good physical condition and know of no medical or other reason why you should not exercise.
You do not have any physical, medical or other disability or condition which may be affected or aggravated by, or which may result in any sickness, injury or death to you as a result of:
1. Active or passive exercise, or
2. Participating in a Class.

If you are unsure about any of the matters set out above, you should not participate in an FCC Class until you have sought professional medical advice and have been given permission from your doctor to participate.

You must not participate in a Class if:

you have an infection, contagious illness or physical ailment, such as an open cut or sore
there is any other risk, however small, to other Members and Guests.

YOU ACKNOWLEDGE AND AGREE THAT PARTICIPATING IN CLASSES AT FCC INVOLVES STRENUOUS PHYSICAL ACTIVITY AND MAY NOT BE SUITABLE FOR ALL PERSONS. IMPROPER USAGE OF ANY ITEM OF EQUIPMENT OR A FAILURE TO FOLLOW INSTRUCTIONS FROM A TRAINER MAY RESULT IN INJURY OR DEATH.

You agree to give us all relevant personal, health and fitness information both before and during the course of any exercise program or other activity that you participate in at FCC. You also agree to complete our Health Form and confirm that all information is correct. In some cases, the responses that you give will require you to see a healthcare professional, in such cases you shall not attend a Class until you have received the necessary care from such professional. You acknowledge that any other screening is no substitute for medical advice and does not guarantee against injury or death. You promise that all the information you provide us with is true and accurate and not misleading in any way. If this information is misleading and an injury, damage or death occurs, you will claim full responsibility and FCC will deny such responsibility.

By signing this Agreement you confirm that you are aware of the risks involved by coming to FCC and by doing the activities offered and that you understand that all sports or fitness that you will execute and participate in are entirely at your own risk and perils.

You accept that by voluntarily assuming the risks involved, you will be solely responsible for any loss or damage that you sustain, including personal injuries, damage to your property or damage arising out of your death.

We may suspend or cancel your Membership if we have reason to suspect that you have not properly complied with any part of this clause.

4. PRIVACY

When you apply for a Membership or Class you will need to provide us with certain information. You agree to FCC accessing personal information about you and using it in relation to your health, fitness and nutrition.

You understand that photos, films, videos or audio recordings are sometimes taken of Members and Guests for promotional purposes. By participating in a Class you are agreeing to these videos being published online.

By agreeing to these Terms, you agree to allow your image or recording to be used for legitimate purposes by FCC.

5. YOUR RESPONSIBILITIES

If you behave in a risky or seriously inappropriate manner, for example, if you threaten or harass others, damage equipment, distribute illicit substances or train other Members without our authorization appropriate action will be taken. For example, your membership may be suspended or cancelled.

If your conduct causes us or another person costs, loss or damages you agree to pay for these.

For your health and safety and the other Members you must ensure you comply with any direction given to you by an Instructor or any other staff member from time to time.

The FCC rules apply to everyone forming part of a Membership or participating in a class. The rules form part of this Agreement and you must make sure you read and understand and follow them at all times.

If you break any rules we will respond in a way we consider fair and appropriate. In less serious cases we may simply give you a warning, however in more serious cases or in the case that you have repeatedly broken the rules we may suspend or cancel your Membership.

If your breach causes another person costs, loss or damages you agree to pay for these.

You promise to always take care of the use of the facilities provided by FCC and all exercise equipment and material, safely and properly. If you are ever unsure of how to use the material and equipment properly you must ask a Trainer before you use it.

You agree to pay for any loss or damage to FCC facilities, equipment and material caused by you through a wilfill, wrongful or negligent act or as a result of your breach of this Agreement.

You agree to follow any direction of a Trainer relating to health, safety or security related matters.

You agree not to bring valuables to a FCC event or facility and agree that it is not the obligation of FCC to look after unattended property.

6. COMMERCIAL ACTIVITY

You acknowledge that engaging in any business activity at FCC, such as offering your own training services or selling goods is prohibited unless given permission to do so by Fitclub Collective.

If FCC gives you written and formal permission, FCC is able to revoke this at any time.

7. FREEZING YOUR MEMBERSHIP

FCC will give you permission to temporarily suspend or freeze your Membership as long as there is good reason and your account is up to date.

You will be allowed to freeze your membership twice over a 6 month period and any additional suspensions will have to be justified. There will be a time limit of one month per suspension, for a longer period you will have to justify your absence. For example, in cases of travel, medical or hardship reasons.

8. CANCELLING YOUR MEMBERSHIP

You can cancel your Membership at any time by telling us in writing that you cannot form part of FCC and participate in classes due to a serious illness or a permanent physical incapacity during the term of your Membership. This must be confirmed by a professional, we may need further verification from a medical professional. If you cancel your Membership due to the reasons above, we may charge you an Administration fee and you will be charged for the time you were a Member (pro rata basis).

A Cancellation Fee is payable if you wish to cancel your Membership for your convenience during the term of your agreement. It is an amount equal to 50% of the balance of your Fees for the remainder of your agreement.

9. TERMINATION

If we cancel your Membership due to a breach on your part, you will be liable for Fees incurred, i.e. Fees for the time you were a member (calculated on a pro rata basis). We may also charge a Cancellation Fee and recover costs, loss or damages caused by your breach.

You promise that you are not bankrupt or insolvent and are able to pay applicable Fees at any time of signing.

10. OUR LIABILITY

Nothing in this Agreement excludes, restricts or modifies any terms, conditions, warranties, guarantees, rights or remedies which cannot lawfully be excluded, restricted or modified. Unless expressly included in this Agreement, all implied terms, conditions, warranties, guarantees, rights or remedies that can be lawfully excluded are excluded. In particular, we are not liable for death or injury caused by our own negligence or breach of implied terms that services will be provided with reasonable care and skill. This does not exclude our liability for reckless conduct.

11. GUESTS

Each Guest agrees to and must comply with the above clauses 3, 4, 5, 6, 10, 12 as if a reference to a Member was a reference to a guest.

12. OTHER LEGAL MATTERS

We are not responsible if Members cannot use our facilities or services because of an event caused by force majeure or any other instance that is beyond our reasonable control. If this continues for a period that extends a month, then either you or we may cancel this Agreement immediately by written notice. In this case, no fee will apply.

If a court, EU law, or Spanish law, deems any part of this Agreement illegal, void or unenforceable, that part will be deleted, however does not invalidate the rest of this Agreement.

If we do not enforce certain rights stipulated under this Agreement at any time, it does not mean that we will not do so in the future.

You agree that we have not made any representations or promises that you have relied on, that are not in this Agreement.

FCC TRAINING MEMBERSHIP AND TRIALS: TÉRMINOS Y CONDICIONES

DEFINICIONES:

Acuerdo significa este documento, que incluye los detalles y los términos y condiciones de Fitclub Collective.

Clase o Clases significa una clase de ejercicio impartida por un entrenador de Fitclub Collective en un estudio.

Tarifas significa las tarifas a pagar por una Membresía o un pago único por una clase individual.

FCC es la abreviatura de Fitclub Collective S.L.

FCC Training significa el método creado por la Fundadora Camila Monguzzi.

Invitado significa cualquier persona que asiste a una clase o clases que no es un Miembro activo.

Formulario de salud es el cuestionario y formulario que FCC requiere como screening antes de participar en una Clase.

Miembro significa una persona que tiene una Membresía con Fitclub Collective.

Membresía incluye una membresía mensual, membresía multipase o una membresía de plan.

Reserva en línea significa el sistema en línea en el que los Miembros o Invitados pueden ver y seleccionar una Clase para asistir y comprar una Membresía.

Términos significa estos términos y condiciones.

Entrenador significa cualquier persona que instruye o asiste con la instrucción de una clase.

"Tú" significa el Miembro o Invitado sujeto a este Acuerdo.

TARIFAS

Las tarifas que debes pagar y los términos de este Acuerdo están disponibles en nuestra página web y pueden proporcionarse en una copia física.

Si no realizas un pago cuando corresponde, tu Membresía puede ser suspendida y se te podría negar el acceso a una Clase hasta que se hayan pagado todas las cantidades pendientes.

Tu membresía puede ser cancelada si quedan impagos los honorarios durante un período de 7 días.

Aún serás responsable de pagar todas las cantidades pendientes.

Si el cliente tiene una justificación válida para romper la permanencia del contrato con Fitclub Collective, el cliente deberá pagar el 50% del monto restante de la totalidad del contrato.

Si pagas alguna tarifa mediante domiciliación bancaria, esto se hará a través de nuestro sitio web.

Al aceptar estos términos y condiciones y proporcionar tu método de pago deseado, nos autorizas a deducir las tarifas de tu cuenta.

SALUD Y SEGURIDAD

Cuando te conviertes en Miembro/te registras para una clase y cada vez que participas en una Clase, debes asegurarte de que:

Te encuentras en buena condición física y no conoces ninguna razón médica u otra por la cual no debas hacer ejercicio.

No tienes ninguna discapacidad física, médica u otra condición que pueda ser afectada o agravada por, o que pueda resultar en enfermedad, lesión o muerte como resultado de:

Ejercicio activo o pasivo, o

Participar en una Clase.

Si tienes alguna duda sobre alguno de los temas mencionados anteriormente, no debes participar en una Clase de FCC hasta que hayas buscado el asesoramiento médico profesional y hayas recibido permiso de tu médico para participar.

No debes participar en una Clase si:

Tienes una infección, enfermedad contagiosa o dolencia física, como una herida abierta o llaga , Hay cualquier otro riesgo, por pequeño que sea, para otros Miembros e Invitados.

RECONOCES Y ACEPTAS QUE PARTICIPAR EN CLASES EN FCC IMPLICA ACTIVIDAD FÍSICA INTENSA Y PUEDE NO SER ADECUADO PARA TODAS LAS PERSONAS. EL USO INADECUADO DE CUALQUIER ELEMENTO DE EQUIPO O EL NO SEGUIR LAS INSTRUCCIONES DE UN ENTRENADOR PUEDE RESULTAR EN LESIONES O MUERTE.

Aceptas proporcionarnos toda la información personal, de salud y fitness relevante tanto antes como durante el curso de cualquier programa de ejercicio u otra actividad en la que participes en FCC. También aceptas completar nuestro Formulario de salud y confirmar que toda la información es correcta. En algunos casos, las respuestas que proporciones requerirán que consultes a un profesional de la salud; en tales casos, no debes asistir a una Clase hasta que hayas recibido la atención necesaria de dicho profesional. Reconoces que cualquier otro examen no sustituye el asesoramiento médico y no garantiza contra lesiones o muerte. Prometes que toda la información que nos proporciones es verdadera y precisa y no engañosa de ninguna manera. Si esta información es engañosa y se produce una lesión, daño o muerte, asumirás toda la responsabilidad y FCC negará tal responsabilidad.

Al firmar este Acuerdo, confirmas que eres consciente de los riesgos involucrados al venir a FCC y al participar en las actividades ofrecidas, y entiendes que todos los deportes o actividades físicas que ejecutarás y en los que participarán son completamente bajo tu propio riesgo y peligro.

Aceptas que al asumir voluntariamente los riesgos involucrados, serás el único responsable de cualquier pérdida o daño que sufras, incluidas lesiones personales, daños a tu propiedad o daños derivados de tu muerte.

Podemos suspender o cancelar tu Membresía si tenemos motivos para sospechar que no has cumplido adecuadamente con alguna parte de esta cláusula.

PRIVACIDAD

Cuando solicitas una Membresía o Clase, necesitarás proporcionarnos cierta información. Aceptas que FCC acceda a información personal sobre ti y la utilice en relación con tu salud, estado físico y nutrición.

Entiendes que a veces se toman fotos, películas, videos o grabaciones de audio de Miembros e Invitados con fines promocionales. Al participar en una Clase, estás aceptando que estos videos se publiquen en línea.

Al aceptar estos Términos, aceptas permitir que tu imagen o grabación se utilice con fines legítimos por parte de FCC.

TUS RESPONSABILIDADES

Si te comportas de manera arriesgada o inapropiada, por ejemplo, si amenazas o acosas a otros, dañas equipos, distribuyes sustancias ilícitas o entrenas a otros Miembros sin nuestra autorización, se tomarán las medidas adecuadas. Por ejemplo, tu membresía puede ser suspendida o cancelada.

Si tu conducta nos causa a nosotros o a otra persona costos, pérdidas o daños, aceptas pagar por ellos.

Para tu salud y seguridad, y la de los demás Miembros, debes asegurarte de cumplir con cualquier dirección dada por un Instructor u otro miembro del personal de vez en cuando.

Las reglas de FCC se aplican a todos los que forman parte de una Membresía o participan en una clase. Las reglas forman parte de este Acuerdo, y debes asegurarte de leerlas, entenderlas y seguirlas en todo momento.

Si infringes alguna regla, responderemos de manera que consideremos justa y apropiada. En casos menos graves, simplemente te daremos una advertencia; sin embargo, en casos más graves o si has infringido repetidamente las reglas, podemos suspender o cancelar tu Membresía.

Si tu infracción causa costos, pérdidas o daños a otra persona, aceptas pagar por ellos.

Prometes cuidar siempre del uso de las instalaciones proporcionadas por FCC y de todo el equipo y material de ejercicio, de manera segura y adecuada. Si alguna vez no estás seguro de cómo usar el material y equipo correctamente, debes preguntar a un Entrenador antes de usarlo.

Aceptas pagar por cualquier pérdida o daño a las instalaciones, equipos y material de FCC causado por ti debido a un acto intencional, indebido o negligente o como resultado de tu incumplimiento de este Acuerdo.

Aceptas seguir cualquier dirección de un Entrenador relacionada con asuntos de salud, seguridad o seguridad.

Aceptas no traer objetos de valor a un evento o instalación de FCC y aceptas que no es obligación de FCC cuidar de propiedad sin supervisión.

ACTIVIDAD COMERCIAL

Reconoces que participar en cualquier actividad comercial en FCC, como ofrecer tus propios servicios de entrenamiento o vender bienes, está prohibido a menos que se te dé permiso para hacerlo por parte de Fitclub Collective.

Si FCC te otorga permiso por escrito y formal, FCC puede revocarlo en cualquier momento.

CONGELAMIENTO DE TU MEMBRESÍA

FCC te dará permiso para suspender temporalmente o congelar tu Membresía siempre que haya una buena razón y tu cuenta esté al día.

Se te permitirá congelar tu membresía dos veces en un período de 6 meses, y cualquier suspensión adicional deberá justificarse. Habrá un límite de tiempo de un mes por suspensión; para un período más largo, deberás justificar tu ausencia. Por ejemplo, en casos de viaje, razones médicas o dificultades.

CANCELACIÓN DE TU MEMBRESÍA

Puedes cancelar tu Membresía en cualquier momento informándonos por escrito que no puedes formar parte de FCC y participar en clases debido a una enfermedad grave o una incapacidad física permanente durante el término de tu Membresía. Esto debe ser confirmado por un profesional; podemos necesitar una verificación adicional de un profesional médico. Si cancelas tu Membresía por las razones mencionadas anteriormente, podemos cobrarte una tarifa de administración y se te cobrará por el tiempo que fuiste Miembro (proporcionalmente).

Se debe pagar una tarifa de cancelación si deseas cancelar tu Membresía por tu conveniencia durante el plazo de tu acuerdo. Es una cantidad equivalente al 50% del saldo de tus Tarifas por el resto de tu acuerdo.

TERMINACIÓN

Si cancelamos tu Membresía debido a un incumplimiento de tu parte, serás responsable de las Tarifas incurridas, es decir, las Tarifas por el tiempo que fuiste miembro. También podemos cobrar una tarifa de cancelación y recuperar costos, pérdidas o daños causados por tu incumplimiento.

Prometes que no estás en quiebra o insolvente y puedes pagar las Tarifas aplicables en cualquier momento al firmar.

NUESTRA RESPONSABILIDAD

Nada en este Acuerdo excluye, restringe o modifica ningún término, condición, garantía, garantía, derecho o remedio que no pueda excluirse, restringirse o modificarse legalmente. A menos que se incluya expresamente en este Acuerdo, se excluyen todos los términos implícitos, condiciones, garantías, garantías, derechos o remedios que puedan excluirse legalmente. En particular, no nos hacemos responsables por la muerte o lesiones causadas por nuestra propia negligencia o incumplimiento de términos implícitos de que los servicios se prestarán con cuidado y habilidad razonables. Esto no excluye nuestra responsabilidad por conducta imprudente.

INVITADOS

Cada Invitado acepta y debe cumplir con las cláusulas anteriores 3, 4, 5, 6, 10, 12 como si una referencia a un Miembro fuera una referencia a un invitado.

OTROS ASUNTOS LEGALES

No somos responsables si los Miembros no pueden utilizar nuestras instalaciones o servicios debido a un evento causado por fuerza mayor o cualquier otra instancia que esté más allá de nuestro control razonable. Si esto continúa durante un período que se extiende a un mes, entonces tú o nosotros podemos cancelar este Acuerdo de inmediato mediante aviso por escrito. En este caso, no se aplicará ninguna tarifa.

Si un tribunal, la ley de la UE o la ley española considera alguna parte de este Acuerdo como ilegal, nula o inexigible, esa parte será eliminada; sin embargo, esto no invalidará el resto de este Acuerdo.

Si en algún momento no hacemos valer ciertos derechos estipulados en este Acuerdo, no significa que no lo haremos en el futuro.

Aceptas que no hemos hecho representaciones o promesas en las que hayas confiado y que no estén incluidas en este Acuerdo.
